Terms of Service

1. The Service

Nitaris turns product photos into short cinematic videos and marketing images using AI. Features, pricing, and limits may change as the Service evolves. We may add, modify, or discontinue parts of the Service at any time.

2. Eligibility and accounts

You must be old enough to form a binding contract in your jurisdiction. You are responsible for the activity under your account and for keeping your credentials secure. On Shopify, the Service is installed against your store and acts on your behalf through the permissions you grant at installation.

3. Credits, purchases, and refunds

• The Service runs on credits. Each generation consumes credits from your balance.
• Credit packs are purchased through the billing provider for your platform — Shopify Billing on Shopify, Google Play on Android, or our web payment provider. Prices are shown before you confirm.
• Credits are added to your account only after the provider confirms the charge. Credits are non-transferable and have no cash value.
• Except where required by law or by the billing provider’s policy, purchases are non-refundable. Refund requests handled by a provider (for example, Shopify or Google Play) are governed by that provider’s terms.

4. Your content and rights

You retain ownership of the photos you upload and the videos and images Nitaris generates from them (“Your Content”). You represent that you have the rights needed to upload Your Content and to have it processed, and that it does not infringe any third party’s rights or violate any law. You grant us the limited rights needed to store and process Your Content to provide the Service (see our Privacy Policy).

5. Acceptable use

You agree not to use the Service to:

• upload content you do not have the rights to, or that is unlawful, infringing, deceptive, or harmful;
• generate content that is illegal, or that impersonates a person or brand in a misleading way;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
• resell or redistribute the Service without our permission.

6. AI-generated output

Generated videos and images are produced by automated AI models and are provided “as is”. Output may vary, may contain inaccuracies, and may not be unique to you. You are responsible for reviewing any output before you publish or use it commercially, including on your product pages.

7. Third-party services

The Service relies on third parties (including Shopify, Google, Anthropic, and Cloudflare) to function. Your use of the Service through a platform such as Shopify is also subject to that platform’s terms. We are not responsible for third-party services we do not control.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that output will meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, Vinayak Gaur will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim.

10. Termination

You may stop using the Service at any time, and on Shopify you may uninstall the app from your store. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to Nitaris, its users, or third parties. On uninstall or account deletion, we handle your data as described in the Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Courts located in India will have jurisdiction over any disputes, subject to any mandatory consumer protections in your place of residence.
